Premises Liability

What is Premises Liability?  Premises liability is when an injury is caused by an unsafe or faulty condition on someone else's property.

Property owners are required to maintain safe conditions.

Manning Law firm represents clients with injuries caused by:

  • Slip and Fall Accidents
  • Dangerous Building Conditions
  • Oilfield Accidents
  • Negligently maintained properties
  • Other dangerous situations

What do I have to prove in order to win a premises liability case?

There are four things you must be able to prove in a court of law in order to have a premises liability case:

  1. The defendant owned or was otherwise responsible for maintaining the property where the incident that caused the injury occurred
  2. The defendant knew or should have reasonably known about the danger and was negligent in maintaining the premises or warning of the risks
  3. The plaintiff suffered harm
  4. The defendant’s negligence directly contributed to the plaintiff’s injury

What are some examples of dangerous conditions which give rise to lawsuits?

Any hazard that the property owner should have removed or warned of, may be considered a dangerous condition in a premises liability case.

Dangerous property conditions that often lead to lawsuits include:

  • Leaks
  • Spills
  • Clutter and debris
  • Open doors and drawers
  • Poor lighting/low visibility
  • Recently waxed or mopped floors
  • Ice and snow
  • Broken stairs
  • Uneven flooring
  • Broken flooring
  • Inadequate security measures
  • Sudden transitions from one kind of flooring to another
